Terms of Use
1. Who we are and what these terms cover
Deadfall ("Deadfall," "we," "us") is operated by Lucas Moeller, an individual located in Wisconsin, USA. These Terms of Use ("Terms") are an agreement between you and Lucas Moeller and cover the Deadfall app and website at agraxapps.com/deadfall and everything you can do in it (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
2. Who can use Deadfall
- You must be 18 or older.
- You must give accurate account information, keep your password private, and not share your account. You're responsible for what happens under your account.
- During early access, new accounts may require an authorization code. We may open, limit or close sign-ups at any time.
- You may not use the Service if you've been removed from it before or if the law doesn't allow you to.
3. Hunting, land and safety: your responsibility
- Know and follow the law. You are solely responsible for complying with all hunting, fishing, trespass, firearm, archery and wildlife laws and regulations, including seasons, bag limits, licenses, tags, shooting hours, zones and units, baiting and feeding rules, and CWD rules.
- Get permission. You must have the landowner's permission before entering or hunting private land. Deadfall's permission tracker and letters are organizing tools only; a record in the app is not permission.
- Map and land data can be wrong. Property lines, owner names and addresses, public land, hunting units, wetlands and other layers come from public government sources (such as county tax rolls through the Wisconsin DNR and the Wisconsin Statewide Parcel Map). They are approximate, can be outdated, and are not a survey. Don't rely on them to decide where a boundary is. When in doubt, stay out and check with the landowner or the county.
- Estimates are estimates. Ballistic tables, bow pin gaps, legal shooting hours, sunrise and sunset, weather, wind and moon data are approximations from models and third-party sources. Confirm your own equipment at the range and check official regulations.
- GPS and phones fail. GPS can be inaccurate, batteries die, and signal drops. Location sharing only updates while the app is open and is not an emergency or safety system. Don't depend on Deadfall to find you or anyone else; tell someone your plan and carry what you need to get home. In an emergency, call 911.
- Hunting and the outdoors carry real risk of injury or death. You take part at your own risk.
4. Your content
"Your content" is anything you add: waypoints, tracks, areas, hunts, sightings, photos, posts, comments, recipes, messages, profile details and similar.
- You own your content. You give Lucas Moeller a non-exclusive, royalty-free, worldwide license to store, copy, display and transmit it only as needed to run the Service and show it to the people you choose (for example, only you, your friends, or everyone). This license ends when you delete the content or your account, except for copies in routine backups until they expire and anything other people already saved or shared.
- You're responsible for your content and must have the right to post it, including photos of other people.
- Visibility settings (Only me, Friends, Public) control who can see content in the app, but anyone who can see something can screenshot or share it. Think before you post.
5. Community rules
Don't use Deadfall to:
- harass, threaten, bully, stalk or impersonate anyone, or post hateful content;
- post, promote or admit to poaching or other illegal hunting, or encourage anyone to break the law;
- share someone else's private information or location without permission, including other people's hunting spots, stands or camera locations;
- use landowner information to harass or pressure a landowner, or contact anyone who asked not to be contacted;
- post graphic content meant to shock, sexual content, or content involving minors;
- spam, advertise without permission, or run scams;
- scrape or bulk-download data, break security, access other accounts, overload the Service, or reverse engineer it except where the law allows;
- sell or transfer your account.
6. Moderation and ending your account
We may review content that is reported to us or that we believe breaks these Terms, and we may remove content, limit features, or suspend or delete accounts, with or without notice. You can report content or accounts in the app. You can delete your account at any time in More > Account; see the Privacy Policy for what that removes.
7. Messages, groups and location sharing
Direct messages are private between the people in the conversation, but they are not end-to-end encrypted and are stored on our server.
Hunting groups. Groups are invite only. Anything you post in a group (chat messages, photos, pins, map items and hunts you share to it) can be seen by everyone who is a member of that group at the time, including people who join later. Group owners and admins can invite and remove members. Leaving a group or deleting your account removes your membership; see the Privacy Policy for what happens to what you already shared.
Hunting partners. When you log a hunt you can tag friends or a group as the people you hunted with. Tagged partners are notified, and the hunt shows in their hunting log too. Only tag people who were actually with you, and remove a tag if someone asks.
Location sharing is off unless you turn it on. You choose who sees it: Public (any signed-in Deadfall user), all your friends, select friends, or only the members of groups you pick. You can also choose an approximate spot instead of your exact one. While sharing is on and you are recording a track or a hunt path, the people you share with can also see the trail you've walked since sharing started. Sharing stops when the time you choose runs out or when you turn it off. Public sharing shows your position to people you may not know; use it with care. Only share your location with people you trust.
Push notifications are off unless you turn them on for a device. You can choose which kinds you get and turn them off any time in the app or in your phone's settings.
8. Third-party services and data
Deadfall shows maps and data from third parties such as Esri, the U.S. Geological Survey, the Wisconsin DNR, the National Weather Service and OpenStreetMap. Those sources have their own terms, and we don't control their accuracy or availability.
9. Changes to the Service and these Terms
Deadfall is an early-stage app. Features may change, break or go away, and the Service may be unavailable at times. We may update these Terms; when we make a meaningful change we'll ask you to accept the new version in the app. If you keep using Deadfall after that, the new Terms apply.
10. No warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T PROMISE THE SERVICE OR ANY DATA IN IT WILL BE ACCURATE, COMPLETE, SECURE, UNINTERRUPTED OR ERROR-FREE, OR THAT DATA WILL NEVER BE LOST.
11. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, LUCAS MOELLER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, TRESPASS CLAIMS, CITATIONS, FINES, LOST DATA OR LOST PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING RELIANCE ON MAP, LAND, WEATHER OR BALLISTIC INFORMATION, OR FROM OTHER USERS' CONDUCT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF $50 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM. Some places don't allow some of these limits, so they may not all apply to you.
12. Indemnity
You agree to defend and hold harmless Lucas Moeller from claims, damages and costs (including reasonable attorneys' fees) arising from your content, your use of the Service, your violation of these Terms, or your violation of any law or anyone else's rights, including a landowner's.
13. Governing law
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Wisconsin, and you and we consent to their jurisdiction.
14. Everything else
If any part of these Terms can't be enforced, the rest still applies. Our not enforcing a term isn't a waiver. You can't transfer these Terms; we may transfer them if Deadfall is transferred. These Terms and the Privacy Policy are the whole agreement between you and us about the Service. Contact: deadfallapp@gmail.com.
